Annie Leeks is an experienced lawyer with more than 10 years of experience in Australia, Canada, and the United Kingdom. She practices in high-pressure litigation and arbitration and has acted for major corporations across a wide range of industries including health care, mining, energy, financial services, aviation, sports, and construction.

Prior to joining Jones Day in 2016, Annie was lead legal counsel and privacy officer at a major airline. She also has worked at a number of international law firms. Her recent experience prior to Jones Day includes acting for a large contractor in a domestic arbitration in relation to the construction of a tunnel, managing a class action for two major construction clients brought in the Federal Court of NSW related to a Brisbane-based toll road, advising a large Australian coal seam gas producer in a gas supply agreement dispute, and advising an international oil and gas company on international arbitration options arising from the detention of employees in Indonesia.

Experience

Class Actions Experience

  • Acting for two major construction clients in a class action brought in the Federal Court of NSW in relation to a Brisbane-based toll road;

  • acting for an ASX listed entity based in Queensland in a proposed shareholder class action which was successfully resolved prior to the commencement of proceedings;

  • acting for a major US manufacturer and distributor of mechanical heart valves in a major product liability class action; and

  • acting for a major US manufacturer of pharmaceuticals and medical devices in various product liability class actions and disputes.

Financial Services Experience

  • Acting for a major Australian financial institution in respect of issues including an ASIC investigation arising out of the collapse of Storm Financial Limited; and

  • acting for various UK-based financial institutions in relation to issues and disputes arising from the collapse of the Icelandic banking industry.

Aviation and Travel Industry Experience

  • Managing high profile litigation between a major Australian airline and its heavy maintenance provider in relation to a dispute under an Alliance Agreement for aircraft maintenance;

  • advising an ASX listed travel provider in relation to a dispute with a US supplier of travel related technology services;

  • overseeing privacy compliance for a major Australian airline and its frequent flyer program, resolving privacy related issues including complaints to the Privacy Commissioner, providing strategic advice to all aspects of the business in relation to data analytics and data monetisation activity;

  • advising on a range of contracts across the airline and loyalty business including drafting and negotiating agreements and advising on and resolving potential disputes arising from those agreements; and

  • appearing in Tribunal and Court hearings and Human Rights Commission conciliations.

Energy and Mining Experience

  • Acting for a large international engineering firm in a SIAC arbitration relating to the design of a mine and processing plant in Vietnam;

  • acting for a gas company on a scheme of arrangement in relation to a potential takeover;

  • acting for a Queensland-based mining joint venture in relation to an insurance claim resulting from the 2010 Queensland floods;

  • acting for an Australian coal supplier in relation to a US$160m arbitration of a dispute regarding a coal supply contract;

  • acting for a multi-national mining company in a dispute with a rehabilitation contractor in the Supreme Court of Queensland;

  • acting for a major US-based energy company in an expert determination concerning the price of natural gas under a long term supply contract;

  • advising a leading company in the UK nuclear industry with respect to negotiations surrounding the purchase of a nuclear facility from the UK government; and

  • advising an international oil and gas company on international arbitration options arising from the detention of employees in Indonesia.

Construction Experience

  • Acting for an Australian engineering group in relation to claims arising from the construction of a gas processing facility in central Queensland;

  • acting for a large contractor in a domestic arbitration in relation to the construction of a major tunnel network in Brisbane, including overseeing an arbitral hearing which ran for more than 3 months;

  • acting for a contractor in a dispute relating to the fabrication and construction of piping for the Condabri and Reedy Creek water treatment facility; and

  • advising a major construction contractor in relation to liability for defects in a new office building in Brisbane CBD.
