Chicago secures arbitration victory in land maintenance dispute with Skyway Concession

Jones Day prevailed on behalf of the City of Chicago ("Chicago") in demonstrating that the Skyway Concession Company ("SCC") breached its 2005 concession and lease agreement with Chicago by failing to maintain certain parcels of land--many in residential areas--that extend around the historic Skyway toll bridge. After a five-day arbitration and post-hearing briefing, a three-person panel denied all the claims in SCC's complaint and granted Chicago's counterclaim for breach requiring SCC to maintain those land parcels for the remainder of the agreement's 99-year term, a potential savings of hundreds of thousands of dollars per year for Chicago taxpayers, a significant victory for Chicago residents who have suffered from blight caused by the lack of maintenance.
