Saputo Cheese secures voluntary dismissal in putative wage and hour class action

Jones Day secured the voluntary dismissal with prejudice of all claims brought against Saputo Cheese USA Inc. ("Saputo") in a putative class action filed in the United States District Court for the District of New Mexico. A former hourly employee at the company's Las Cruces cheese processing plant filed an action on behalf of himself and a proposed class of all current and former hourly employees, asserting claims under the New Mexico Minimum Wage Act.

The plaintiff alleged that Saputo failed to compensate employees for time spent on pre- and post-shift activities, including donning and doffing. The complaint sought unpaid overtime wages, treble damages, injunctive relief, and attorneys' fees and costs on a class-wide basis. The plaintiff voluntarily dismissed the action with no settlement paid by Saputo.
