MD Helicopters secures preliminary injunction protecting supply of critical aircraft parts

Jones Day secured a preliminary injunction on behalf of MD Helicopters, LLC ("MD"), a leading manufacturer of commercial, military, law enforcement, and air-rescue helicopters, preserving the ordered supply of these critical parts. Shortly before the Presidents' Day holiday weekend, MD Helicopters' exclusive bearings supplier gave MD roughly 24 hours' notice of its intent to terminate pending purchase orders without cause because MD would not amend the payment terms the parties had previously agreed to. This threat imperiled MD Helicopters' ability to sustain the more than 1,600 helicopters currently in service around the world, which would have led to "aircraft on ground" situations that could have put lives at risk. Jones Day sought a temporary restraining order and preliminary injunction on behalf of MD Helicopters to restrain the supplier from terminating the purchase order in breach of the parties' agreement. Jones Day secured an appearance before the court on a Sunday, followed by issuance of a temporary restraining order on the Presidents' Day holiday. After additional briefing and two hearings, the court converted the temporary restraining order to a preliminary injunction that ensures the continued supply of these critical helicopter parts.
