RE/MAX wins dismissal of antitrust litigation brought by competitor in Utah

On behalf of RE/MAX International, Inc., Jones Day secured dismissal with prejudice of antitrust litigation brought by a competitor in Utah that claimed a conspiracy involving RE/MAX, other major brokerages/franchisors, and the National Association of Realtors had the effect of excluding startup competition and caused the competitor to go out of business. Siding with defendants, the court held the claims were time-barred by a four-year statute of limitations, and further that plaintiff failed to plausibly claim how it was harmed by the defendants' allegedly anticompetitive actions or allege that defendants actually participated in any alleged boycott.
