MPLX and Marathon Petroleum prevail in merger litigation

Jones Day successfully defended MPLX LP and Marathon Petroleum Corporation against shareholder lawsuits filed in Delaware challenging MPLX's $15 billion merger with MarkWest Energy, one of the largest processors of natural gas in the United States. After the merger was completed and a motion to dismiss was filed, plaintiffs voluntarily dismissed their lawsuit as moot claiming that increases in the merger price were attributable to the plaintiffs’ litigation. After initial briefing on the mootness issue, plaintiffs withdrew their motion for fees.
