Harsco settles claims, prevails in post-bankruptcy litigation with Taylor-Wharton

Jones Day represented Harsco Corporation as the largest unsecured creditor and major landlord in the chapter 11 cases of pressurized gas tank and valve manufacturer Taylor-Wharton International LLC. A settlement of bankruptcy claims issues was negotiated on behalf of Harsco with the Taylor-Wharton debtors, which emerged from bankruptcy in June 2010. In November 2010, Jones Day prevailed on a motion to dismiss significant post-bankruptcy litigation against Harsco Corporation over the effect of the rejection of certain pre-bankruptcy contracts between Harsco and the Taylor-Wharton debtors.
