Jones Day achieved a dismissal on the pleadings of action seeking benefits under a disability benefits policy. The Court found that the plaintiff's claims of alleged misrepresentation of plan terms failed as a matter of law because the statements in question were not even arguably misrepresentations and the plaintiff's alleged reliance was unreasonable as a matter of law.
