Medtronic secures Federal Circuit reversal holding Medtronic's retained patent rights sufficient for Article III standing

On behalf of Medtronic Ireland Manufacturing Unlimited Co. ("Medtronic"), Jones Day obtained a Federal Circuit reversal of a district court's dismissal order that had found patent owner Medtronic lacked exclusionary rights sufficient for constitutional standing. The Federal Circuit held that Medtronic's rights retained under a license agreement, including the right to sue others and veto authority over sublicenses, established Article III standing. The court of appeals remanded, preserving Medtronic's ability to enforce its renal neuromodulation patents. Jones Day also successfully expedited the appeal, obtaining reversal within 10 months of filing the appeal.
