R.J. Reynolds Vapor Company secures PTAB victory in electronic vaping patent dispute

Jones Day secured an inter partes review (IPR) petitioner win at the Patent Trial and Appeal Board (PTAB) for our client R.J. Reynolds Vapor Company ("Reynolds") relating to electronic vaping technology. Healthier Choices Management Corporation ("HCMC") asserted a patent against Reynolds in the Middle District of North Carolina. On behalf of Reynolds, Jones Day filed an IPR petition in September 2024 challenging the patent based on prior art. The Firm secured a stay of the district court action pending the outcome of the IPR. Jones Day persuaded the PTAB to find all challenged claims of the asserted HCMC patent unpatentable in a Final Written Decision issued in March 2026.
