Dan Berens is an experienced complex commercial litigator, particularly in multidistrict litigation and coordinated state proceedings. He focuses his practice on difficult commercial litigation with an emphasis on the defense of product liability, mass tort, and consumer protection cases in state and federal courts.
Dan's recent experience includes defending a major pharmaceutical manufacturer in investigations brought by state attorneys general related to allegations of price-fixing, market allocation, and consumer deception; and he has continued his representation in related multidistrict litigation. Dan is also defending a manufacturing client against thousands of product liability claims in state and federal coordinated proceedings across the country.
He also recently defended a national retailer in lawsuits brought in jurisdictions across the country alleging that the distribution and sale of prescription opioids constitutes a public nuisance and a violation of various state and federal laws, including cases brought by state attorneys general.
Dan also maintains an active pro bono practice. As part of Jones Day's Border Project, he is serving as lead trial counsel for an individual seeking to obtain political asylum in the United States.
Before joining Jones Day, Dan clerked for Judge L. Scott Coogler of the United States District Court for the Northern District of Alabama.
