Exide Technologies prevails in matter involving French trade unions

Jones Day represented Exide Technologies SAS in a matter involving La Fédération Confédérée FORCE OUVRIERE de la Métallurgie, la Fédération Nationale CFTC des Syndicats de la Métallurgie, la Fédération Générale des MINES et de la METALLURGIE-F.G.M.M.-C.F.D.T. et la Fédération des Cadres de la Métallurgie CFE-CGC. The afore- mentioned trade unions summoned on March 29, 2009 EXIDE TECHNOLOGIES SAS to a hearing before the Nanterre Tribunal (Tribunal de Grande Instance) in which they asked the judge to suspend the Book II procedure (relating to the reorganization of the Transportation division and the closing down of the Auxerre plant) until a consultation on the strategy of the company takes place, as mentioned in the Agreement on the GPEC (Projected management of the jobs and competencies) signed on March 5 by the trade unions and Exide Technologies S.A.S. Such summons was aimed at obtaining a court decision rapidly (référé).

The Court rendered its decision on April 21, 2009 and rejected the plaintiffs' demands to suspend the Book II procedure. No appeal was lodged, the case is thus closed.
