Jones Day successfully obtains reinstatement of long term disability benefits for an attorney with the Legal Aid Society

Jones Day successfully obtained the reinstatement of long term disability benefits for a Criminal Practice staff attorney with the Legal Aid Society. The client sought representation to challenge, at the administrative level, an erroneous termination of her long term disability benefits by Unum, the Legal Aid Society's disability insurance carrier. Unum based the termination of benefits on its finding that the client's reported severe symptoms were excessive. However, with our appeal of Unum's decision, we submitted extensive "objective medical evidence" and examples from recent case law demonstrating that the client's symptoms were not excessive and were, in fact, severe. As a result, Unum reversed its termination decision and reinstated the client's long-term disability benefits, in addition to providing retroactive payment of the disability benefits that she did not receive while her claim was pending.
