Jones Day successfully resolved a complex wage and hour class and PAGA action filed against an international materials manufacturer. Jones Day strategically litigated the matter by removing both the class action complaint and the separately filed PAGA complaint on an unconventional theory of LMRA preemption. Following removal, Jones Day defeated two motions to remand. With both cases firmly in Federal Court, Jones Day was able to efficiently resolve both cases on terms favorable to our client.
