CSXT wins against claims of discrimination, harassment, and retaliation upheld by Eleventh Circuit

Jones Day represented CSX Transportation, Inc. in a lawsuit brought by a former conductor alleging that he was terminated as a result of discrimination, retaliation and experienced a racially hostile work environment. The United States District Court for the Northern District of Alabama dismissed the lawsuit, finding that: (i) the conductor was not dismissed for discriminatory or retaliatory reasons, but was in fact dismissed for misconduct; and (ii) did not experience a racially hostile work environment. The Eleventh Circuit affirmed that the conductor failed to establish a hostile work environment based on a single non-recurring incident -- the only claim which the conductor appealed.
