Affordable Care Act plaintiffs present argument before Supreme Court

Client(s) Competitive Enterprise Institute, et al.

On March 4, 2015, Jones Day presented oral argument before the U.S. Supreme Court in a high-profile challenge to an IRS regulation implementing the Affordable Care Act. The challengers, represented by Jones Day, contend that under the Act, federal subsidies for health insurance are available only in states that have established their own insurance Exchanges. Two federal appellate panels divided on that question, leading the Supreme Court to grant review in November 2014. The case is widely seen as one of the most consequential cases of the current Supreme Court Term. Jones Day handled the case since its inception in September 2013.
