Jones Day advised a nonprofit medical foundation regarding the denial of its application for tax-exempt status as a section 501(c)(3) organization. The foundation is associated with a public hospital and provides medical care to the same community. After the IRS proposed to deny our client's application, it turned to Jones Day for assistance. Working against short IRS deadlines, and relying on their extensive experience with the IRS on exempt organization matters, the Jones Day team assisted the medical foundation in making adjustments to its structure and operations and succeeded in persuading the IRS to recognize the medical foundation as a section 501(c)(3) tax-exempt organization.
