MedQuest receives favorable decision in FCA case

Client(s) MedQuest Associates, Inc.

Jones Day represented MedQuest Associates, Inc. in a False Claims Act matter in which the Sixth Circuit Court of Appeals issued a decision favorable to the defense, a case originally filed in the Middle District of Tennessee. The Sixth Circuit found favorably for defendants holding that conditions of participation cannot serve as the basis for a false claim. The Sixth Circuit concluded that liability under the False Claims Act was not warranted on either of the two claims in the case, and therefore reversed the district court's judgment in excess of $11 million.
