Jones Day was retained by Pret A Manger (USA) Ltd. to defend the company in a lawsuit brought by a former employee alleging that he and a class of current and former Managers in Training were misclassified as exempt from federal and state overtime laws. At the time Jones Day was retained, the case had been placed on an abbreviated discovery schedule that allowed very little time for discovery in advance of class certification proceedings. Jones Day was successfully able to limit the scope of its discovery obligations and then obtain a very favorable settlement of the case after only limited discovery had taken place.
