R.J. Reynolds obtains summary judgment in 40-count wrongful death action

Jones Day represented R.J. Reynolds Tobacco Company in a 40-count survival and wrongful death action alleging that the decedent's lengthy smoking history caused his lung cancer and, ultimately, his death. Plaintiff sought compensatory and punitive damages for a variety of claims based on fraud, negligence, failure to warn, and strict liability. After extensive discovery, the trial court awarded Reynolds complete summary judgment finding that the plaintiff lacked sufficient evidence to support the necessary elements of her claims.
