Tenant obtains dismissal of eviction action and waiver of all alleged past-due rent; landlord required to make repairs
Client(s) C.G.
Jones Day represented a tenant who lives with her teenage children and newborn in an apartment that is infested by cockroaches and rodents and contaminated by mold, among other issues. Her landlord filed suit for possession, alleging that she owed over $15,000 in back rent. But the numerous housing code violations provided a counterclaim and defense, and the case has now settled on highly favorable terms. The landlord agreed to waive all past-due rent, dismiss the case and repair over 10 enumerated violations within 60 days; our client agreed to waive her counterclaim upon completion of the repairs.
