CSXT obtains summary judgment against sexual harassment and retaliation claims

Client(s) CSX Corporation

Jones Day obtained summary judgment on behalf of CSX Transportation, Inc. against a retaliation claim by a former carman. The Court specifically held that Plaintiff could not establish the elements of his claim and that he was terminated for misconduct, not in retaliation for allegedly reporting behavior which did not amount to sexual harassment.
