Aaron Seong's practice centers on advising clients in energy and derivatives transactions and related regulatory matters.
Aaron advises commercial users, financial institutions, investors, data centers, developers, energy companies, energy marketers, government entities, and other market participants in renewable energy, traditional energy and other energy and environmental commodity and derivatives transactions, as well as related project finance and development. His experience includes renewable energy, natural gas, battery energy storage systems (BESS), physical and financial power purchase agreements (PPAs), secured hedges, repurchase transactions, carbon allowances, carbon credits, and methane capture projects. He also has advised financial institutions, investment funds, and corporations on negotiating and documenting equity derivatives transactions, such as accelerated share repurchases, prepaid variable share forwards, and total return swaps.
As part of his practice, Aaron also seeks to contribute to the development and improvement of industry standard transaction documentation. As a key member of the team engaged by the International Swaps and Derivatives Association (ISDA), Aaron was central to drafting the industry standard ISDA Global Financial Power Purchase Agreement (FPPA) Confirmation Template, the ISDA U.S. Renewable Energy Certificate (REC) Annex, and the ISDA EU Guarantee of Origin (GO) Annex.
