Dan Berens is a trial lawyer who focuses his practice on complex commercial litigation, including actions involving public nuisance, false advertising, debtor-creditor disputes, and state law veil piercing theories, as well as initiating and defending adversary proceedings related to chapter 11 bankruptcy.

Dan has successfully represented clients in all stages of litigation. He is well versed in initial proceedings and has successfully litigated multiple motions to dismiss. Dan is also experienced in modern discovery practices, including e-discovery, discovery-related motions practice, and has taken multiple depositions.

Dan serves as lead defense counsel for one of the nation's major credit reporting agencies in cases brought under the Fair Credit Reporting Act (FCRA) and has successfully first chaired multiple trials with full defense verdicts. Dan is currently defending a major retailer in dozens of cases brought by states, counties, cities, and others alleging that the distribution and dispensing of prescription opioids constitutes a public nuisance. He has also defended a national marketplace lender in a federal action asserting alter ego and other veil piercing claims.

Dan also maintains an active pro bono practice. As part of Jones Day's Border Project, he is serving as lead trial counsel for an individual seeking to obtain political asylum in the United States.

Before joining Jones Day, Dan clerked for Judge L. Scott Coogler of the United States District Court for the Northern District of Alabama.
