Michael McFerran advises Fortune Global 500 and emerging companies on cybersecurity, data privacy, artificial intelligence (AI), and strategic technology transactions, helping clients protect key intellectual property and data assets while navigating complex regulatory frameworks.
Michael represents companies in significant domestic and cross-border transactions, counseling on cybersecurity, privacy, and AI matters in connection with mergers and acquisitions, lending and credit facilities, outsourcing and technology transactions, transitional services arrangements, contract remediation, and other commercial arrangements.
Michael also develops practical compliance strategies and programs relating to obligations under state, federal, and global data privacy and AdTech legislation, such as the California Consumer Privacy Act (CCPA), General Data Protection Regulation (GDPR), Health Insurance Portability and Accountability Act (HIPAA), Telephone Consumer Protection Act (TCPA), and Controlling the Assault of Non-Solicited Pornography and Marketing Act (CAN-SPAM), and ecommerce and industry security standards, such as the Payment Card Industry Data Security Standard (PCI DSS), ISO/IEC 27001, and NIST SP 800-53/171. He also assists clients with cybersecurity risk and incident management, including HIPAA Security Incidents, risk assessments, forensic and governmental investigations, third-party risk management, and compliance with applicable notification obligations.
Michael has been named to the State Bar of Michigan Pro Bono Honor Roll every year of his practice for his substantial pro bono work, which includes advising nonprofit organizations, representing persecuted individuals seeking asylum, and assisting disabled combat veterans as a VA Accredited Attorney.
