August Melcher represents clients in high-stakes intellectual property (IP) matters before the Court of Appeals for the Federal Circuit (CAFC), the Patent Trial and Appeal Board (PTAB), and U.S. district courts, with a focus on life sciences patent litigation.
August's practice spans a variety of technologies, including small molecule therapeutics; biologics; medical devices; noninvasive, cell-free DNA testing technology; and gene sequencing technology. His experience includes formulating invalidity and noninfringement positions, managing discovery, working with expert witnesses, taking and defending depositions, preliminary injunctions, and pre/post-trial motion practice, as well as trials and appeals. August also has experience counseling clients regarding IP issues related to corporate transactions.
August is dedicated to pro bono services, and his experience includes § 1983 civil rights litigation, VAWA (Violence Against Women Act) immigration petitions, and Veterans Affairs benefits appeals.
While in law school, August served as an extern at New York University Langone Health's Department of Technology Transactions. He also has served as a researcher and instructor at the University of California, Berkeley's Department of Chemistry.
