UPMC obtains dismissal of federal court class action on behalf of uninsured patients

Jones Day successfully defended the University of Pittsburgh Medical Center (UPMC) and five of its affiliated hospitals in obtaining dismissal of a federal court class action on behalf of uninsured patients who were allegedly overcharged for medical care and then allegedly subjected to abusive collection tactics. The plaintiffs claimed that UPMC and its hospitals violated their charitable obligations under Section 501(c)(3) of the Internal Revenue Code and local tax laws. They also asked the court for injunctive relief, the imposition of a constructive trust, damages and a court-ordered schedule of pricing for the uninsured.
