For almost 20 years, Dan Merrett has represented clients in complex, high-profile corporate restructurings and chapter 11 reorganizations. He counsels companies across a variety of industries as well as equity sponsors, secured lenders, trade creditors, purchasers, and other significant stakeholders in court-supervised and out-of-court restructurings. In the course of these representations, Dan regularly assists clients navigating all manner of transactions, disputes, and other business activities, including issues relating to structural optimization, acquisitions and divestitures, credit facilities, securities, environmental obligations, suppliers, vendors, contractors, customers, employees, labor, taxation, corporate governance, and executive compensation.
Dan has substantial experience counseling clients with respect to the management of mass tort liabilities, including the recent chapter 11 cases of affiliates of Johnson & Johnson filed to resolve talc claims. He has also represented stakeholders in connection with a number of significant energy and infrastructure projects, including, among others, the owners of the Vogtle nuclear power plant in Westinghouse's chapter 11 case and the Cameron LNG facility in McDermott's chapter 11 case.
Dan was an important member of the restructuring teams in the historic bankruptcies of the City of Detroit and Chrysler. His other company-side chapter 11 representations include AFA Foods, Alpha Natural Resources, Dana Corporation, M&G Chemicals, and Transtar Industries. He has written and presented extensively on bankruptcy topics. He is a member of the American Bankruptcy Institute and is recognized in the field of restructuring by Chambers USA.
