Kevin Holewinski coordinates the environmental, health & safety practice in the Firm's Washington Office and the Firm's environmental litigation practice. Kevin is a litigator with vast complex civil, environmental, toxic tort, and criminal litigation experience. During his tenure at the U.S. Department of Justice, Kevin tried over 25 cases in a variety of substantive areas, including school desegregation, fair housing, criminal, and environmental law, in federal district courts in Alabama, Mississippi, Indiana, Illinois, Virginia, Washington, and the superior and district courts in the District of Columbia.
Kevin's focus on complex environmental litigation began while he served in the Department of Justice's Environmental Enforcement Section. There he litigated claims under all major environmental statutes and was lead trial counsel several of the department's most significant enforcement matters. During his tenure at the Department of Justice, Kevin received a number of awards for his trial work.
Since joining Jones Day, Kevin's litigation practice has been diverse and has involved a wide range of clients and claims. Kevin has represented steel, manufacturing, utility, chemical, oil and gas, and computer industry clients in civil enforcement and public nuisance actions, criminal investigations, OSHA investigations, insurance coverage litigation, toxic tort litigation, cost recovery, and contract litigation. Through these and other litigation matters, Kevin has developed extensive experience in air and groundwater contamination issues, human and ecological risk assessment, the science of climate change, as well as in the pursuit of contract, statutory, and other claims against the United States in the U.S. Court of Federal Claims and in federal district court.
Kevin has been profiled in the Chambers USA directory of America's Leading Business Lawyers since 2004. This year's Chambers guide describes Kevin as "[a] fantastic litigator and appellate lawyer." And in The Legal 500 (2008), Kevin is recommended in the category of environmental litigation and described as both a "recognized national expert in the field" and is "best-in-class." Kevin has written and lectured on a wide range of topics, including citizen suits, the defense of environmental civil penalty and injunctive claims, the treatment of environmental claims in bankruptcy, environmental criminal enforcement, and federal contractor claims against the United States. Kevin is frequently asked to provide commentary to the major media on a wide range of environmental litigation issues, including climate change litigation and federal and state government enforcement efforts.
