Leading relocation management software provider prevails in agency level protest

Jones Day successfully represented a leading relocation management software solutions provider in an agency-level protest of the government’s notice, published in FedBizOpps, of a sole source award to a competitor.

The protest challenged the government’s sole source award decision because the government lacked a rational basis to determine the client’s competitor was the only responsible source for the requirement and that no other supplies or services will satisfy the government’s requirements. The protest also argued that the government’s request for expressions of interest and information, published several months before the sole source award was announced, was insufficient because it failed to accurately put potential offerors on notice of the government’s minimum needs. Less than three weeks after the protest was filed, the Agency took corrective action which included cancellation of the sole source award, giving the client an invitation to submit market research, and making the determination that the client is a responsible source and issuing a competitive solicitation for the requirement.
