Xcel Energy defends property damage class action claiming that global climate change caused Hurricane Katrina

Jones Day represents Xcel Energy Inc. in connection with a class action suit filed by individuals whose property was damaged by Hurricane Katrina. Plaintiffs claim that defendants' emissions contributed to global climate change and caused the hurricane. The Court dismissed the claims in August 2007 on standing and political question grounds. The Fifth Circuit Court of Appeals on October 16, 2009 reversed the District Court decision and remanded the case for further proceedings. Motions for rehearing have been filed.
