Cart.com secures voluntary dismissal of novel pen register claim after filing motion to dismiss

Jones Day successfully defended Cart.com in an action asserting novel data privacy claims. Plaintiff asserted that Juicy Couture's website, which Cart.com operates, improperly collected the interactions of users' interaction on the website. Plaintiff alleged that the website's collection of consumer data constitutes use of a pen register or trap device in violation of California's Comprehensive Computer Data Access and Fraud Act, Cal. Penal Code § 502, and the pen register provision in CIPA, Cal. Penal Code § 638.51. After moving to dismiss all claims, Plaintiff voluntarily dismissed the case.
