David DiMeglio's practice focuses on complex civil litigation, particularly toxic torts and product liability. He has defended mass tort cases across the country involving the pharmaceuticals, electronics, agriculture, equipment manufacturing, and consumer products industries. David has defended products ranging from prescription drugs and consumer electronics to off-road vehicles and heavy equipment. He also has defended against claims of cancer, asbestosis, silicosis, sterility, and chronic diseases. He has substantial experience defending against claims of employment discrimination, wrongful termination, breach of contract, fraud, unfair business practices, and violations of California's Proposition 65 and other state and federal environmental laws.
David's recent trial experience includes a high-profile case for IBM involving complex issues of chemical exposure and alleged health effects. After a nearly five-month trial, the California jury returned a unanimous defense verdict, which was recognized as one of the top defense verdicts of 2004.
More recently, David was trial counsel for Dole in a closely watched five-month trial involving 12 plaintiffs from Nicaragua who claimed that their exposure to a pesticide, DBCP, on banana farms in the 1970s caused sterility. The jury returned a defense verdict for half the plaintiffs, and post-trial rulings knocked out the rest.
David currently represents Yamaha as co-lead counsel in a California coordinated proceeding involving more than 100 product liability cases.
David is coordinator of the Los Angeles Office Trial Practice. He is a member of the ABTL and the Mexican-American Bar Association.
