Chuck Wehland advances the interests of clients in the energy industry by counseling and defending them in climate, sustainability, and environmental matters.

His work on transactions includes environmental diligence and negotiation of the environmental terms of transaction agreements in dozens of deals for facilities, including refineries, electric generating units, midstream gas processing units, exploration and production operations, manufacturing plants, and transportation operations.

Chuck frequently counsels energy sector clients on implementation of standards affecting the composition of their products such as the Renewable Fuel Standards (RFS) or Low Carbon Fuel Standards (LCFS). He advises companies on legal strategies related to greenhouse gas emissions and associated requirements.

Clients also turn to him for help in developing sustainability programs that implement environmental, social, and governance goals appropriate to the business. As a result, he is conversant in the relevant auditing and reporting criteria that can be used to measure progress toward those goals.

On the disputes side, Chuck's cases have established important precedents for Clean Air Act enforcement and cleanup matters under Superfund and hazardous waste laws.

Chuck regularly writes and lectures on environmental subjects. He is active in several bar associations, including the Environment, Energy and Resources Section of the ABA.

  • Coal companies prevail in Supreme Court battle over EPA's powerIn a high-profile and much-awaited decision on the final day of its term, the Supreme Court ruled in favor of Jones Day's client, the North American Coal Corporation, by reversing a D.C. Circuit decision that gave the EPA sweeping authority to transform the power sector as a means of reducing greenhouse gas emissions.

  • Marathon Petroleum purchases BP's Texas City refinery and related logistics and marketing assetsJones Day advised Marathon Petroleum Corporation (MPC) in its purchase of BP's Texas City refinery, three intrastate NGL pipelines originating at the refinery, an allocation of BP's Colonial Pipeline Company shipper history, four terminals, retail marketing contract assignments for approximately 1,200 branded sites and a 1,040 megawatt cogeneration (cogen) facility for a base purchase price of $598 million, plus inventories estimated at $1.2 billion and an earnout provision under which MPC could pay up to an additional $700 million over six years, subject to certain conditions.

  • Firestone Building Products resolves civil penalty and enforcement actionJones Day defended Firestone Building Products Company against a civil penalty and enforcement action brought by the South Coast Air Quality Management District (Southern California), claiming that certain roofing adhesives manufactured and sold by Firestone in California exceeded the South Coast's VOC limits. The action was resolved on favorable terms.

("ARP"), a recently formed master limited partnership, in connection with its entry into a definitive purchase and sale agreement to acquire approximately 277 bcfe of proved reserves, including undeveloped drilling locations, in the Barnett Shale in Texas from Carrizo Oil & Gas for approximately $190 million.
  • Chesapeake Midstream Partners agrees to acquire gas gathering assets in Marcellus Shale from Chesapeake Energy for $865 millionJones Day advised Chesapeake Midstream Development L.P., one of the energy industry's largest midstream MLPs, in its acquisition of Appalachia Midstream Partners, L.L.C. ("AMS") from Chesapeake Midstream Development, L.P. ("CMD"), a wholly owned subsidiary of Chesapeake Energy Corporation.
