In Biscotti Inc. v. Microsoft Corp., Magistrate Judge Payne recommended that estoppel under §315(e) apply broadly against Microsoft in an upcoming patent infringement trial scheduled for early June 2017. No. 2:13-CV-01015-JRG-RSP, Dkt. No. 191 (E.D. Tex. May 11, 2017) (Slip Op.). Judge Payne’s recommendation rested on a narrow interpretation of two prior Federal Circuit decisions: (1) Shaw Industries Group, Inc. v. Automated Creel Systems, Inc., 817 F.3d 1293 (Fed. Cir 2016), which addresses estoppel under §315(e)(2) applicable in district court proceedings, and (2) HP Inc. v. MPHJ Technology Inv., LLC, 817 F.3d 1339 (Fed. Cir. 2016), which addresses estoppel under §315(e)(1) applicable in other PTAB proceedings. Id. at 9-13.
