Jones Day named to National Law Journal's "Appellate Hot List" for fifth consecutive year

On December 27, 2016 Jones Day was named to the National Law Journal's annual "Appellate Hot List" for the fifth consecutive year. 

According to the NLJ, it was not just a formidable year for the Firm in terms of the number of arguments, but that the large number of arguments  eight  were made by five different lawyers. Beth Heifetz, head of the Issues & Appeals Practice noted, "It really speaks to the depth of our bench that we have so many tremendously able Supreme Court advocates." 

The Firm won four cases during the Term, including overturning former Virginia Gov. Robert McDonnell's corruption conviction, restricting RICO's civil extraterritorial application, defining "actual fraud" under the bankruptcy code, and a pro bono matter related to the "judgment bar" of the Federal Tort Claims Act (FTCA). The NLJ noted that one of the eight cases is still pending decision — NLRB v. SW General, a challenge under the federal Vacancies Reform Act. 

The five Jones Day lawyers who argued before the Court included Noel Francisco, Shay Dvoretzky, Gregory Katsas, Michael Carvin, and Christian Vergonis. "If you look at the cases, they are about equally split between those we were brought into to handle at the Supreme Court level and cases we brought up through Jones Day," Mr. Dvoretzky said. And according to Ms. Heifetz, "McDonnell v. United States was won on a theory that the Firm raised and preserved at trial." 

Justice Antonin Scalia's death affected two cases brought by the Firm this Term. The justices split in a major union case, Friedrichs v. California Teachers Association, leaving in place a decision by the Ninth Circuit. The justices also sent back for settlement discussions on the contraceptive insurance challenge in Zubick v. Burwell.
