John Kinton's notable experience as a trial attorney and engineer allow him to effectively represent clients in patent infringement proceedings, patent invalidation proceedings, PTAB proceedings, and technology litigation. His practice focuses on both domestic and cross-border patent disputes. John has handled cases in many venues, including the major patent litigation venues in U.S. District Court, the U.S. International Trade Commission (ITC), as well as courts in the United Kingdom, Germany, Norway, Canada, and Brazil.

In 2016, John was a member of the trial team that achieved the record-breaking patent infringement verdict for Idenix Pharmaceuticals (a subsidiary of Merck & Co.), the largest infringement verdict in U.S. history. After a two-week trial, the jury ordered Gilead Sciences to pay $2.54 billion in damages for sales of sofosbuvir-based medicines, including Sovaldi and Harvoni, for its infringement of an Idenix patent related to the treatment of patients with hepatitis C virus (HCV) infection.

John has experience in cases spanning a range of technologies, including telecommunication systems, computer software, computer hardware, pharmaceuticals, medical devices, semiconductors, aircraft seating systems, and water and wastewater treatment systems. He also has handled cases involving standards organizations, including patents related to the 3GPP, CDMA, h.264, MPEG, JPEG, and JEDEC standards.

Representative clients include Agilent, CareFusion, General Electric, Hoist Fitness Systems, Idenix Pharmaceuticals, Kodak, Kyocera, Lexar, Merck, Micron, Motorola, and Virgin Atlantic Airways.

Before entering private practice, John was general counsel and director of engineering at Charybdis Technologies in Carlsbad, California. He also was a patent engineer and program manager at Boeing (formerly McDonnell Douglas) in St. Louis, Missouri.
