PCS Phosphate cooperates with North Carolina Department of Environmental Quality to address alleged exceedances of new federal standards for mercury air emissions

Jones Day represented PCS Phosphate Company, Inc. in negotiations with the North Carolina Department of Environmental Quality (NCDEQ) concerning alleged exceedances of a new federal standard for mercury air emissions. Negotiations resulted in NCDEQ issuing a consent order that includes a path for PCS Phosphate to investigate emissions at its facility while also challenging the new emissions standard under federal law. Jones Day is representing PCS Phosphate in petitioning the U.S. EPA to revise the standard.
