Progressive defends against FLSA collective action challenging exempt status of classification of Special Investigators

Jones Day represented Progressive Corporation in a collective action under the FLSA which challenged the classification of Special Investigators and related positions (current and former) on a nationwide basis as exempt from the FLSA's overtime pay requirements. The lawsuit also alleged separate claims for those members of the class resident in California under California state wage and hour laws, including claims for waiting time penalties following termination, and failure to provide accurate wage statements or required meal and rest breaks.
