Parents granted right to adopt their foster son

Jones Day Washington office associates Carmen G. McLean and Elizabeth J. Betta, who were referred by the Children's Law Center, successfully represented two foster parents in the adoption of their foster son, in D.C. Superior Court. The child was adjudicated neglected in 2002 and has lived with the foster parents for two years. His biological mother consented to the adoption so the questions remaining at trial were 1) whether his biological father had waived his consent to the adoption or, in the alternative, was withholding consent contrary to the child's best interests and 2) whether it was in the child's best interests to be adopted by the foster parents. After testimony from the prospective adoptive father and the child's social worker, the Court ruled in favor of the foster parents.
