CBS successfully petitions for certiorari before Supreme Court in third-party asbestos lawsuit

On behalf of CBS Corporation, Jones Day successfully led efforts to obtain Supreme Court review in Air & Liquid Systems Corp. et al. v. DeVries, No. 17-1104 (U.S.). The case presents the question whether products-liability defendants can be held liable under maritime law for injuries caused by products that they did not make, sell, or distribute. The question frequently arises in the context of asbestos suits. There, plaintiffs sue the producers of equipment for injuries caused by third-party asbestos added to the producers’ equipment decades after its sale. In DeVries, the Supreme Court granted review of a Third Circuit decision holding that equipment producers can be held liable for in these circumstances. The Supreme Court will likely hear argument at some point this Fall.
