Daikin defends against patent infringement claims involving its fluoropolymer products, obtains inter partes review of asserted patents in USPTO and stay of litigation

Jones Day is representing Daikin Industries, Ltd. and Daikin America, Inc. in a patent infringement suit brought by Chemours Company FC, LLC in U.S. District Court in Delaware. Chemours alleges that several Daikin fluoropolymer products used in high-speed extrusion and wire coating applications infringe two patents owned by Chemours. Jones Day is also representing both Daikin entities before the Patent Trial and Appeal Board (PTAB) in petitions for inter partes review of the two Chemours patents. On November 13, 2018, the PTAB instituted both IPRs for all grounds and all claims of the two patents-in-suit. On December 21, 2018, the Delaware court granted Daikin’s motion to stay the litigation pending IPR.
