Dexcom obtains stay of patent infringement action filed by AgaMatrix

Jones Day is defending Dexcom, Inc. in a patent infringement action before the United States District Court for the District of Oregon (Portland Division). Plaintiff AgaMatrix (now WaveForm Technologies, Inc.) alleges that the sensors used in Dexcom's continuous glucose monitoring devices and systems infringe three patents which AgaMatrix acquired from iSense Corporation. Dexcom successfully petitioned the PTAB to commence IPRs as to all asserted claims of two patents asserted in the litigation by plaintiff. The PTAB's institution decision was issued on March 6, 2017. On March 22, 2017, the district court granted Dexcom's motion to stay the case in its entirety.
