Disabled veteran granted disability benefits on appeal after multiple denials

United States Army veteran Kevin Tune was unable to work as a result of numerous medical conditions and subsequent treatment stemming from his fourteen years of service as an armored crewman. He applied for disability benefits from the Social Security Administration (“SSA”), but was denied in September 2015. Jones Day assumed representation of Kevin after his initial application was denied. Attorneys from the Dallas office worked with him on his first appeal, helping him gather medical and service related documents, assembling a record, and drafting persuasive narratives supporting his application. That appeal was submitted in November of 2015, but he was once again denied benefits in late January 2016. The attorneys proceeded to draft and submit his further appeal to an Administrative Law Judge (“ALJ”) at the SSA, requesting a hearing to review his claim for benefits. Upon review of the appeal and the submitted record, the ALJ overturned the denial and fully granted Kevin's appeal without a hearing, ordering that his disability benefits revert to the date of his original injury in April 2015.
