Meggitt defends against class action litigation over allegedly vested retiree medical benefits

Jones Day represented Meggitt Aircraft Braking Systems Corporation ("Meggitt) in a class action litigation brought by retirees (former union employees) who asserted their retiree medical benefits were vested. On January 1, 2015, Meggitt required all Medicare-eligible retirees who had worked at Meggitt's Akron, Ohio facility to transition from a Company-sponsored plan to a health reimbursement account ("HRA") system. Meggitt provides an annual subsidy to each Medicare-eligible retiree's HRA which the retiree could then use to purchase a health care plan on the individual marketplace. Meggitt was able to negotiate a mutually agreeable settlement for all parties.
