Guardianship granted to grandmother of child whose mother suffers from mental illness

Hilary Perkins and Nikki McArthur, supervised by Louis Fisher, represented a maternal grandmother and her husband in their petition for permanent guardianship of her daughter's 1-year-old son. At the time the child was born, his mother was suffering from psychiatric issues that left her unable to care for him. CFSA removed the child from his mother's care and placed him in kinship foster care with his grandmother and her husband, whom he lived with for the next year. Following the guardianship hearing, the Court held that permanent guardianship by his grandmother and her husband was in the child's best interests. As desired by all parties, the child's mother retains some parental rights and will stay involved in the child's upbringing.
