Carlson and Radisson successfully defend premises liability action
Clients Carlson Holdings, Inc. and Radisson Hotels International, Inc.
Jones Day represented Carlson Holdings, Inc., the parent corporation, and its subsidiary, Radisson Hotels International, Inc., the franchisor, in a premises liability action stemming from an assault in a Boston hotel garage. Carlson successfully opposed an effort to add it as a defendant in the litigation. The Radisson franchisor obtained a summary judgment in its favor after arguing that the prevailing Massachusetts standard required a plaintiff to demonstrate active control of the premises by the franchisor in order for liability to attach.
