Jones Day advised an NHS Foundation Trust on a long-term service contract for the provision of 'soft' facilities management services; the contract was originally procured within the framework of the UK's private finance initiative (PFI). The Matter included Service Variations, price review mechanisms (including Benchmarking and Market Testing), the interface with the legal test set out in Pressetext [2008] ECR I-4401, Directive 2004/18/EC on the coordination of procedures for the award of public service contracts, and Directive 2014/24/EU on public procurement. The engagement also addressed a fundamental question on the reach of a "validly procured network" within the context of EU Public Procurement Law.
