Inmate successfully appeals dismissal of motion to vacate sentence

Jones Day, serving as pro bono counsel appointed by the U.S. Court of Appeals for the Sixth Circuit, represented prison inmate Adrian Hamilton in his successful appeal. The district court had held that Mr. Hamilton's plea agreement waived his right to move to vacate his sentence. The Sixth Circuit reversed the district court and remanded for further proceedings. The Sixth Circuit held that Mr. Hamilton's claim--for ineffective assistance of counsel based on his lawyer's failure to file a notice of appeal in his criminal case--was not barred by the plea-agreement waiver.
