Electronics for Imaging prevails on Federal Circuit appeal

Jones Day represented Electronics for Imaging, Inc. in a patent infringement action brought by Digitech Image Technologies. Following an early motion for summary judgment, the district court granted summary judgment of invalidity as to each of the asserted claims based on 35 U.S.C. 101. The district court's ruling was subsequently affirmed in a precedential opinion, one of the first following the Supreme Court's decision in Alice Corp. v. CLS Bank Int'l, finding that all patent claims asserted against Electronics for Imaging were invalid under 35 U.S.C. 101 because the claims were either drawn to non-statutory subject matter or were drawn to an abstract concept.
